Busch Will Not Face Criminal Charges

The Delaware prosecutors announced Thursday that they will not file any criminal charges against suspended NASCAR driver Kurt Busch.

Busch won’t be charged over the alleged assault of his ex-girlfriend, Patricia Driscoll, at Dover International Speedway in September. Driscoll accused Busch of slamming her head into a wall of his motorhome.

The decision by the Delaware Attorney General’s office followed a lengthy investigation that began after Driscoll filed a complaint with police Nov. 5.

NASCAR indefinitely suspended the Stewart-Haas Racing driver before the Daytona 500 after a family court commissioner issued a detailed opinion Feb. 20 saying that Busch had committed an act of domestic violence against Driscoll.

The Delaware Department of Justice issued a statement Thursday:

“The Delaware Department of Justice has carefully reviewed the complaint made of an alleged act of domestic violence involving Kurt Busch in Dover on September 26, 2014, which was reported to the Dover Police Department on Nov. 5, 2014 and investigated. After a thorough consideration of all of the available information about the case, it is determined that the admissible evidence and available witnesses would likely be insufficient to meet the burden of establishing beyond a reasonable doubt that Mr. Busch committed a crime during the September 26th incident.

“Likelihood of meeting that high burden of proof is the standard for prosecutors in bringing a case. For this reason, the Department of Justice will not pursue criminal charges in this case.”

Busch has taken the first steps to be reinstated, agreeing to the NASCAR guidelines. NASCAR has not revealed those terms, but is using a domestic violence expert to help determine Busch’s path for reinstatement.
